Who is the administrator of my personal data?

The personal data controller is Elerte Poland Sp. z o. o. with its registered office in Mieronice, Mieronice 160, 28-366 Małogoszcz (hereinafter referred to as Elerte Poland Sp. z o. o.)

What personal data does the Administrator process?

Elerte Poland Sp. z o. o., as a personal data controller within the meaning of the GDPR, processes in particular the following personal data:
  • Personal data of job candidates (data that candidates provide to the administrator in connection with participation in recruitment processes – in particular data included in the CV)
  • Personal data of contractors and their representatives (data of companies* and contact persons – basic data used for issuing and recording invoices (name, tax identification number, business address) and for contact (name, surname, company name, job position, e-mail address, telephone number))
  • People submitting inquiries via contact forms, email, and telephone (basic contact details (name, surname, e-mail address) provided by persons in connection with questions sent to the administrator)
  • Personal data processed in connection with maintaining profiles on social media platforms LinkedIn, Facebook, YouTube, Instagram

* – Company data is treated as personal data only when it allows for the identification of individuals. Data relating to capital companies is not treated as personal data.

* – GDPR = Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation)

On what principles does the Administrator process my personal data?

Below we present the principles of processing your personal data (in particular, we explain who has access to it, how long it is stored and what are the grounds for its processing).

Personal data of job candidates

  • Purposes and basis of data processing: Your personal data will be processed for the purposes of the recruitment process or also for the purposes of future recruitment processes if you have given your consent (the basis for the processing of these data are the applicable legal regulations (in particular the Labor Code) and the consent granted by you)
  • Data recipients: This data may be made available to entities authorized by law. Entities supporting Elerte Poland Sp. z o. o. in terms of IT services and infrastructure may also have access to the data under appropriate agreements.
  • Storage period: The personal data processed by the controller will be stored until the recruitment process is completed or until you withdraw your consent in the event of data processing for the purposes of future recruitment processes.
  • Data Transfer to a Third Country: Elerte Poland Sp. z o.o. generally does not transfer data outside the European Economic Area (EEA), however, there may be situations in which Elerte Poland Sp. z o.o. will use IT service providers whose headquarters/servers may be located outside the EEA. In such cases, the basis for data transfer will be standard contractual clauses approved by the European Commission.
  • Automated decision-making/profiling: Elerte Poland Sp. z o. o. does not make decisions based on automated processing, including profiling (in relation to the data processing purposes described above).
  • Voluntary/obligatory provision of data: Providing personal data to the extent required by law, in particular the Labor Code, is obligatory; in other cases, it is voluntary.

Personal data of contractors and their representatives

  • Purposes and basis of data processing: Personal data of contractors will be processed for the purposes of implementing contracts concluded between the parties (pursuant to Article 6 paragraph 1 letter b of the GDPR – processing is necessary for the performance of contracts to which you are a party) and for the fulfilment of obligations imposed on the controller under applicable law (Pursuant to Article 6 paragraph 1 letter c of the GDPR – processing is necessary to fulfil the legal obligations incumbent on the controller (in particular in the scope of issuing and storing VAT invoices), resulting from, among others, the Accounting Act and the VAT Act. Personal data of contractors' representatives will be processed for contact purposes, including for the purpose of establishing and maintaining business contacts (Pursuant to Article 6 paragraph 1 letter f of the GDPR – the legitimate interest of the data controller, which is to ensure contact with the contractor and to ensure the implementation of agreements concluded with contractors) as well as for the purposes of fulfilling the obligations imposed on the controller under applicable law (Article 6 paragraph 1 letter c of the GDPR). Personal data of contractors and their representatives may also be processed for the purpose of pursuing and defending claims (the basis for data processing is Article 6(1)(f) of the GDPR – the legitimate interest of the data controller, which is pursuing and defending against claims).
  • Data recipients: This data may be made available to entities authorized by law. Entities supporting Elerte Poland Sp. z o. o. in the field of IT services (particularly hosting providers) may also have access to the data under appropriate agreements.
  • Storage period: Personal data of contractors and their representatives will be retained for the period required by applicable law. Contact details of contractor representatives processed for business purposes will be retained until such time as an objection to the processing of such data is filed.
  • Data Transfer to a Third Country: Elerte Poland Sp. z o.o. generally does not transfer data outside the European Economic Area (EEA), however, there may be situations in which Elerte Poland Sp. z o.o. will use IT service providers whose headquarters/servers may be located outside the EEA. In such cases, the basis for data transfer will be standard contractual clauses approved by the European Commission.
  • Automated decision-making/profiling: Elerte Poland Sp. z o. o. does not make decisions based on automated processing, including profiling (in relation to the data processing purposes described above).
  • Voluntary/obligation to provide data: Providing personal data is voluntary, but necessary to conduct business contacts with Elerte Poland Sp. z o. o. and to implement agreements between the parties.

People submitting inquiries via contact forms, email, and telephone

  • Purposes and basis of data processing: Personal data will be processed for the purpose of conducting electronic correspondence and implementing actions taken at your request (the basis for data processing is the legitimate interest of the data controller, which is conducting electronic correspondence and implementing actions taken at the request of data subjects).
  • Data recipients: This data may be made available to entities authorized by law. Infrastructure and IT service providers processing data on behalf of Elerte Poland Sp. z o. o. may also have access to the data under appropriate agreements.
  • Storage period: Personal data processed by the administrator will be stored for the duration of electronic correspondence and then for archival purposes for the period specified in the administrator's office instructions.
  • Data Transfer to a Third Country: Elerte Poland Sp. z o.o. generally does not transfer data outside the European Economic Area (EEA), however, there may be situations in which Elerte Poland Sp. z o.o. will use IT service providers whose headquarters/servers may be located outside the EEA. In such cases, the basis for data transfer will be standard contractual clauses approved by the European Commission.
  • Automated decision-making/profiling: Elerte Poland Sp. z o. o. does not make decisions based on automated processing, including profiling (in relation to the data processing purposes described above).
  • Voluntary/obligation to provide data: Providing personal data is voluntary, but necessary to exchange electronic correspondence or take actions at your request.

Personal data processed in connection with maintaining profiles on social media platforms LinkedIn, Facebook, YouTube

Personal data administrators: The controllers of personal data processed on LinkedIn, Facebook and YouTube are also the entities operating the indicated portals:

  • LinkedIn Ireland Unlimited Company, which processes your personal data on the terms described in this place.
  • Facebook Ireland Ltd, which processes your personal data on the terms described in this place.
  • The administrator of the YouTube portal, who processes your personal data on the principles described in this place.
  • Meta Platforms Ireland Limited (Instagram), which processes your personal data on the terms described in this place.

hereinafter collectively referred to as the "Portals"

Purposes and basis of data processing: Elerte Poland Sp. z o.o. processes your personal data to operate profiles on portals, in particular to share posts, conduct discussions in comments, conduct correspondence in the form of private messages, as well as for statistical purposes (obtaining statistics that are compiled based on your behavior on our profile (e.g. post views)) and, in justified cases, also for the purpose of defense and pursuing claims. These activities constitute the legitimate interest of Elerte Poland Sp. z o.o. (Article 6, paragraph 1, letter f of the GDPR), which constitutes the basis for the processing of your personal data.

Data recipients: In the case of sharing posts/conducting discussions, authorized employees of Elerte Poland Sp. z o. o. have access to this data., portals, as well as other individuals and entities, about whom you can read in the privacy policies of the portals. References to these privacy policies are provided in the "Personal Data Administrators" section.

Storage period: Your personal data will be stored for the period defined in the portals' privacy policies.

Transfer of data to a third country: Elerte Poland Sp. z o.o. generally does not transfer data outside the European Economic Area (EEA), however, there may be situations in which Elerte Poland Sp. z o.o. uses IT service providers whose servers may be located outside the EEA. In such cases, the basis for data transfer will be standard contractual clauses approved by the European Commission.

Automated decision-making/profiling: Elerte Poland Sp. z o. o. does not make decisions based on automated processing, including profiling (in relation to the data processing purposes described above).

Voluntary/obligation to provide data: Providing personal data is voluntary, but necessary to post comments/send private messages to Elerte Poland Sp. z o. o. /using other functionalities of the portals.

What rights do I have in relation to the processing of my personal data by Elerte Poland Sp. z o.o.?

You have the right, as appropriate, to:

  • request access to your personal data, rectification, deletion and restriction of processing, as well as the transfer of your personal data;
  • Withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
  • object to the processing of your personal data
  • filing a complaint with the supervisory authority (PUODO – President of the Personal Data Protection Office)
